Background

A couple has been married for 18 years and has one child.

In 2002, they separated, with the wife staying in China and the husband moving to Australia. At the time of separation, neither of them had any assets.

After the separation, the husband entered into a de facto relationship with another woman, and together they accumulated $3 million in assets by 2016, all of which were in the husband's name.

The wife then sued the husband to claim a share of his assets in Australia, arguing that there was no separation, she had no assets in China, and she wanted a portion of the husband's Australian assets.

Dispute and Result

From 2015 to 2018, the husband successfully delayed the matter for 3 years. After the 3 years and after tens of thousands of legal fee, the wife decided that her application would cost more than it was worth. She discontinued her matter. The husband retained all of his assets.
