Background

A couple has been married for 6 years and has 1 child.

At the time of their marriage, both individuals possessed significant assets in China, including properties, businesses, and stocks.

After immigrating to Australia, the husband continued his business endeavors while the wife assumed the role of a housewife.

Dispute and result

Both parties desired custody of the child and a significant portion of the assets.

Shortly before the legal proceedings, the husband sent the child back to China. He filed a lawsuit seeking 70% of the assets.

The wife also sought 70% of the assets and made an unsuccessful attempt for an order to retrieve the child from China.

Ultimately, the parties reached a settlement where the husband became the sole parent and received a majority share of the assets.

The above case shouldn't be blindly applied, as the court has arrived at opposite outcomes in similar cases.
